DjVu Plugin 3.5.300 Rev. 1 - reversion to BETA state?

Today we discovered that LizardTech has released (made available for download on their website) the DjVu Web Browser Plug-in 3.5.300 Rev. 1 Released "4-01".  The "Rev 1" is mentioned only in the License Agreement for the plug-in. It does not appear in the "About DjVu" box of the plug-in, which continues to say Version 3.5.300, even though this is clearly a new version.  We assume that the release date means April, 2001, since the previous release had a release date of "01/02" which we assumed to be January 2002. Yes the release dates are going backwards, but so is the change from finished software to beta software.

Also, the DjVu Plug-in download page says:

Filesize: 1.91 MB
Version: 3.5.3 - english
Released: 3-5-2002

The size is correct, but the release is number is actually 3.5.300, and this is a different version of the plug-in than the version that was actually released on 3-5-2002.

The first thing we notice about this release are that the size of the plugin has decreased from 2.004 MB to 1.962 MB.  Then we notice that the license agreement states that this is a beta release. The 3.5.300 release made on March 5, 2002 was NOT a beta release.  It makes no sense to us why this is beta version replaces a released version or why the release dates are going backwards.

We do not know why LizardTech chose to give this new release the same release number as the previous version.  We do not know why the plugin suddenly became "beta" in this release. Is this just a mistake in the license agreement?

As with the earlier 3.5.300 release, this new release is not announced or documented on the LizardTech site. It is just "there" now when you click the Download or Install buttons.

It we learn more about this "upgrade" from LizardTech, we will post it here as a News update or will make comments in the Forum.

We notice that the minor bugs identified in our earlier review of the 3.5.300 plugin released 3/5 have not yet been fixed in this upgrade (the Zoom and Rotate buttons do not disable).

While looking for clarifications on the LizardTech website, we noted that the last entry to the LizardTech Knowledge Base concerning the DjVu plugin was made 5 months ago, and the Troubleshooting Guide for DjVu Browser Plug-in - #33195  on the support page actually talks about the Mr. Sid plug-in instead!

We notice a change in the License Agreement apart from the fact that it is now labeled as Beta software. You are no longer permitted to copy or distribute the plugin to others for any reason whatsoever.

We are also concerned about a new clause added to the license which states:

LICENSEE SHALL NOT USE, COPY, DISTRIBUTE OR TRANSFER IN ANY FORM ANY FILES CREATED BY LICENSEE'S USE OF THE SOFTWARE

Since the only files that you CAN create with this application result from doing a Save As, or extracting image files from a DjVu, does this mean you have no rights to those files that you saved or extracted?

Finally, we worry that since the plugin can no longer be copied or distributed, can the plug-in still be considered to be "free"?  And since it can be obtained now only from the single LizardTech server, is this sufficient?  What if the LizardTech server goes down for a week, as happened a few weeks ago?
There are many unanswered licensing and release-management questions in this DjVu plug-in update.

On the other hand, this plug-in update works as well as the previous plug-in release in our actual testing, so we are thankful for that, and by all means continue using DjVu!

NOTICE TO USER: THIS IS A CONTRACT
This Software is a BETA release and may not be redistributed and is for Non-Commercial use only.

LizardTech is willing to license the enclosed Beta Software and Related Materials to You only on the condition that You accept all of the terms and conditions contained in this License Agreement ("Agreement"). Please read the terms and conditions carefully before installing or using the software. By installing or using the software, You indicate Your acceptance of the LizardTech software license Agreement. If You do not agree to the terms of this Agreement, LizardTech is unwilling to license the software to You. In that event, You should either not download the Software, or return the Software and all Related Materials to LizardTech with any packaging unopened, as applicable.

1.     Scope of Permitted Use. In this Agreement, "Software" shall mean the machine readable software programs and associated files known as DjVu Browser Plug-in 3.5.300 and any modified versions, upgrades or other copies of such programs and files, and any associated media and printed materials. You have the nonexclusive, nontransferable right to install and use the Software on a single central processing unit for Your private Non-Commercial use only. This Software is not designed for, or permitted to be used on, a server or network which permits access by multiple users. Licensee shall not sell, rent, sublicense, or otherwise provide unlicensed third parties access to any version(s) of the Software or Related Materials, or Licensee's rights under this Agreement.

You may not use the Software to commercially distribute DjVu-encoded imagery and under no circumstances may You operate as a service bureau to encode images for third persons. If You wish to engage in commercial distribution of DjVu encoded imagery, please contact LizardTech or visit our Website at www.lizardtech.com to learn more about our products and services that will permit You to do so.

You are expressly prohibited from making any copies of the Software or from distributing the software, for any reason whatsoever.

2.     Proprietary Rights. The Software is owned by LizardTech and/or its suppliers and You acknowledge that the structure, organization, and/or code to the Software is/are the valuable trade secret(s) of LizardTech and is/are protected by United States Copyright Law and International Treaty provisions. The Software is protected by U.S. Patent No. 6,058,214. Additional US and Foreign Patents Pending. You agree to hold such trade secret(s) in confidence. You further agree not to translate, decompile, disassemble, modify, reverse engineer, or otherwise attempt to discover the source code of the Software, in whole or in part.

3.     No Other Rights. LizardTech retains title and ownership to any and all copies of the Software whether transmitted electronically or recorded as diskette or CD copies and all subsequent copies of the Software, regardless of the form or media in or on which the original and other copies may exist. Except as expressly stated herein, this Agreement does not grant You any rights to patents, copyrights, trade secrets, trademarks, or any other rights with respect to the Software.

4.     Term. This Agreement is effective at the time You download the software. Additionally, this Agreement shall terminate automatically upon failure by Licensee to comply with any of its terms. Upon termination of the Agreement You must destroy the Software. In the event of termination, You agree that any provisions of this Agreement that operate to protect LizardTech shall remain in force.

5.     Non-Commercial Use. As used in this Agreement, "Non-Commercial Use" means use of the Software and any files created by its use solely for education, research, personal, or recreational uses. "Non-Commercial Use" excludes, without limitation (i) any use of the Software or files created by its use for, as part of, or in any way in connection with, a product (including software) or service which is sold, offered for sale, licensed, leased, loaned, or rented, or (ii) any use of the Software or any files created by its use for the creation and distribution of materials among persons (including persons employed by Licensee) on a private network or intranet. EXCEPT AS EXPRESSLY AUTHORIZED UNDER THIS AGREEMENT, LICENSEE SHALL NOT USE, COPY, DISTRIBUTE OR TRANSFER IN ANY FORM ANY FILES CREATED BY LICENSEE'S USE OF THE SOFTWARE.

6.     NO WARRANTY. This Software is a Beta release and is being delivered to You AS IS. LizardTech makes no warranty as to its use or performance. LIZARDTECH AND ITS SUPPLIERS DO NOT AND CANNOT WARRANT THE PERFORMANCE OR RESULTS YOU MAY OBTAIN BY USE, OR INABILITY TO USE, OF THE SOFTWARE OR THE DOCUMENTATION. LIZARDTECH MAKES NO WARRANTIES, EXPRESS OR IMPLIED, AS TO NON-INFRINGEMENT OF THIRD PARTY RIGHTS, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.

7.     Support. This Software is provided without support or maintenance of any kind, except such help resources as LizardTech may elect, in its sole discretion, to make publicly available on its Website.

8.     WARNING. This Software is not designed nor tested for a level of reliability suitable for use in any information system the failure of which can reasonably be expected to cause personal injury. The Software contains bugs and inaccuracies and You can expect errors, anomalies, and incorrect results under normal use. This Software performs "lossy" data compression. You agree to take precautions to offset such risks, such as maintaining full backups of storage media and not using the Software where personal injury or property damage may result.

9.     Governing Law. This Agreement will be governed by the laws in force in the State of Washington, U.S.A. This Agreement will not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded.

10.     Export Control. You agree that the Software will not be shipped, transferred, or exported or reexported into any country or used in any manner prohibited by the United States Export Administration Act or any other export laws, restrictions, or regulations. Specifically, and without limitation, You agree that the Software will not be downloaded or otherwise exported or reexported to (or to a national or resident of) Cuba, Iraq, Libya, Sudan, North Korea, Iran, Syria or any other country or person to which the United States has embargoed goods. By agreeing to this Agreement, You are certifying that You are not national of one of these countries, or otherwise a person with whom the U.S. government has prohibited trade.

11.     Entire Agreement. You acknowledge that You have read this Agreement, understand it and that it is the complete and exclusive statement of Your Agreement with LizardTech which supersedes any prior Agreement, oral or written, between LizardTech and You. No variation of the terms of this Agreement will be enforceable against LizardTech unless LizardTech gives its express consent, in writing signed by an officer of LizardTech.

    -Documentation Update: To set the default alignment of the DjVu file in
    the viewing window type the <embed> or <object> tags in the HTML text of the
    web page using DOC_ALIGN="one of nine options".
    -Documentation update: To set the default rotation of a DjVu file in the
    viewing window type the <embed> or <object> tag in the HTML text of the
    document using ROTATE=180 degrees (90 for 90 degree, 270 for 270 degree).
    The document rotates clockwise.
    -Documentation correction: Zoom in increases from 5% to 25%, then
    follows the settings from the Select Zoom drop down menu to 300%.
    Then the increases occur by 100% to a maximum of 1200%. The reverse
    occurs for Zoom Out.
    -Documentation correction - Zoom selected area only pertains to
    the Zoom in feature.
        -Document correction - The "passive" attribute, used with the <embed> or
        <object> tags, has been changed to properly reflect that it is not a binary
        attribute. To use the "passive" attribute, use "&passive" without the
        "=yes/no" qualifiers.
    - Documentation correction - The <object> tag may not good for  Win98/ME
          in combination with IE5.x, as in the following example.

        </object>
      A better way to use object tag is:

      However, both examples work properly on WinNT/Win2000/XP and IE6.x

  IV Known Issues
-------------------------------------------------------------------
  The following known issues exist for the DjVu Web Browser Plug-in:

-Using Frames with DjVu: When building a web page with frames, if you include
        links to pages of an indirect or bundled DjVu document in one frame and
        want to display the page of the document in the second frame, you may see
        the plug-in reloading the new DjVu page. To avoid this behavior
        use the thumbnails feature for navigation within the DjVu document.
        -Using slow internet connections: When using a slow internet connection,
        such as a 28.8 modem, if you repeatedly click a thumbnail or a new page
        before the download is complete, Internet Explorer may appear to freeze.
        This problem is due to the messaging system in Windows not immediately
        communicating with the plug-in. The plug-in is occupied with downloading
        the DjVu file, and does not receive the message from Internet Explorer
        until  the download is complete.
        -Caching with DjVu: If you experience slow performance with the DjVu plug-in,
        increase your cache size under Internet Explorer.
